ARMORY D-295. FRESNO COUNTY SHERIFF'S OFFICE JAIL DIVISION POLICIES AND PROCEDURES TITLE: DETENTION BUREAU ARMORIES NO: D-295 FILE: ARMORY EFFECTIVE DATE: 11-01-98 REVISED: 07-01-99, 04-01-00 AUTHORITY: Sheriff M. Mims APPROVED BY: Captain M. Leonardo REFERENCE: Title 15, Section 1029. PURPOSE: The purpose of this policy is to establish and maintain a secure and consistent method of access to the equipment stored within the Detention Bureau Armories. POLICY: It is the policy of the Fresno County Sheriffs Department Detention Bureau that only authorized personnel shall possess, utilize, remove and/or return equipment to or from the Main Jail Armory. It is the policy of the Fresno County Sheriff's Department Detention Bureau that all Department issued gun belts, handguns, shotguns and ammunition assigned to the Detention Bureau shall be stored and locked in the gun lockers in the Main Jail Armory when not in use. It is the policy of the Fresno County Sheriffs Detention Bureau that only those staff members who have received departmentally approved training in the use of emergency security equipment shall be authorized to utilize the equipment during actual operations. It is the policy of the Fresno County Sheriffs Detention Bureau that a designated SERT Sergeant shall maintain an inventory of all emergency equipment assigned to the Fresno County Sheriffs Department Detention Bureau facilities. All records shall be maintained for a minimum of three (3) years. PROCEDURES: I. AVAILABILITY AND CONTROL OF EQUIPMENT STORED IN THE MAIN JAIL ARMORY A. Only those officers who have successfully completed departmentally approved training courses in the proper use and deployment of emergency security equipment shall be authorized to utilize the equipment during operations. B. No weapons (i.e., firearms, mace, O.C. gas, etc.) shall be allowed into the secured areas of the facility. The only exception shall be during emergency situations, with approval by the Watch Commander. III. THE SERT ARMORY - SECTION OMITTED FOR SECURITY PURPOSES IV. EQUIPMENT CARE A. A designated officer shall have the responsibility for the care and cleaning of all Armory equipment on a monthly basis. A. Under no circumstances shall any person be authorized to tamper with or alter in any manner, any emergency security equipment. V. EQUIPMENT INVENTORY A designated SERT Sergeant shall be responsible to: A. Maintain a log containing the location, type of weapon and serial number of each emergency security weapon assigned to the Detention Bureau. B. Submit an annual inventory to the SERT Commander. The report shall be submitted during the last pay period of December, and a copy shall be forwarded to the Detention Programs & Services Bureau Commander. The annual report shall include the following information- 1. The emergency equipment located in each facility, categorized by type. 2. The equipment on hand at last inventory. Report all equipment destroyed due to wear, use or obsolescence to the ATF on a quarterly basis. VI. MISFIRES In case of misfires or duds, the SERT Commander shall be notified immediately for direction. A. Munitions which are under warranty that have malfunctioned or are damaged shall be returned to the manufacturer for quality control, determination of cause of malfunction, and replacement. B. Munitions no longer under warranty shall be forwarded to the SERT Commander for proper disposal. VI I. DOCUMENTATION A. A detailed report of the deployment or use of any emergency equipment shall be completed via the CMS system by the individual who utilized the equipment. The report shall include the following information- 1. The efforts and personnel involved who attempted to remove the inmate(s) from the area, or disperse inmates during a major disturbance, prior to the use of the emergency equipment. 2. Type of device used and serial number. 3. Medical attention and assessment of the inmate after evaluation by medical staff. B. The use of emergency equipment constitutes a use of force and, as such, must be reported in accordance with standard departmental use of force reporting requirements (see Departmental Policy and Procedure Section 701). C. The SERT Commander shall review the use of emergency equipment as soon as practical following each incident or operation to insure the equipment was used according to policy and that the equipment functioned properly.
