PURPOSE: The purpose of this policy is to establish and maintain a method of providing incarcerated people with clean jail-issued clothing, bedding, and linen on a regular basis. POLICY: It is the policy of the Fresno County Sheriffs Office Jail Division to maintain all personal clothing received from an incarcerated person, and to issue them jail clothing, bedding, and linen prior to their entry into a housing unit. It is the policy of the Fresno County Sheriffs Office Jail Division to maintain a quantity of clean clothing, bedding, and linen available for actual and replacement needs of the incarcerated population. It is the policy of the Fresno County Sheriffs Office Jail Division that mattresses shall be free of holes and tears. Mattresses with holes, tears, or that lack sufficient padding shall be replaced upon request It is the policy of the Fresno County Sheriffs Office Jail Division to launder all jail-issued clothing once each week. It is the policy of the Fresno County Sheriffs Office Jail Division to launder all blankets prior to issue, and every ninety (90) days thereafter, upon request. Page 1 of 14 FRESNO COUNTY SHERIFF'S OFFICE JAIL DIVISION POLICIES AND PROCEDURES TITLE: JAIL CLOTHING NO: E-110 FILE: CLOTHING PROCEDURES: I. PERSONAL CLOTHING A. Each incarcerated person will have their personal clothing exchanged for jail-issued clothing prior to their entry into a housing unit. 1. The incarcerated person's shoes and personal clothing will be itemized on a PERSONAL CLOTHING screen, and the condition noted. [BOOKING,PROPERTY] 2. The clothes and shoes will be placed inside a plastic bag and vacuum sealed. Exceptions apply only to hats, sharp belt buckles, overly large boots, and wet or soiled Items. [Refer to Addendum A.] 3. The sealed bag will be placed inside a garment bag. Each garment bag is imprinted with a rack number, which shall be indicated on the PERSONAL CLOTHING screen. [BOOKING,PROPERTY; RACK#] [Refer to the Main Jail Clothing Officer Post Orders (H-235/PO MJ CLOTHING)for storage procedures.] B. All incarcerated people are given the opportunity to shower and may request to have their soiled clothing washed at the time they dress into jail clothing. 1. The incarcerated person will be notified that all of their clothing will be washed together. Colors and fabrics will not be separated. 2. All personal clothing will be placed into the incarcerated person's assigned garment bag (i.e., loose, not sealed). The garment bag shall then be placed into the laundry cart that contains the dirty clothes. The laundry crew will wash, dry, and return the clothes to the Clothing Room. 3. Once the personal clothing is washed and returned to the Clothing Room, the clothes need to be vacuum-sealed, replaced into the garment bag, and stored in accordance with the assigned rack number. C. The incarcerated person shall be offered a receipt for their personal clothing at the time it is taken from them. Page 2 of 14 FRESNO COUNTY SHERIFF'S OFFICE JAIL DIVISION POLICIES AND PROCEDURES TITLE: JAIL CLOTHING NO: E-110 FILE: CLOTHING II. CLOTHING, BEDDING AND LINEN ISSUE AT THE TIME OF BOOKING Each incarcerated person admitted to the facility will be issued a set of jail clothing, bedding, and linen. The incarcerated people are responsible for the safekeeping and proper use of their entire clothing, bedding, and linen issue while they are in custody. A. Every incarcerated person shall be issued the following- 1. One (1) pair of footwear 2. Three (3) pairs of socks 3. Two (2) towels 4. Three (3) sheets (linen) 5. Two blankets (bedding) 6. One (1) net laundry bag 7. A personal care pack that contains an Inmate Orientation Handbook, basic hygiene items and correspondence materials (i.e., a toothbrush, toothpaste, comb, soap, writing paper, a pencil, two stamped envelopes, a razor, plastic cup, and a roll of toilet paper). The incarcerated person may be charged up to $2.50 by the commissary provider for the pack. B. In addition, each incarcerated male will be issued the following items: 1. Two (2) red jumpsuits 2. Two (2) white t-shirts 3. Three (3) sets of underwear C. Each incarcerated female will be issued the following additional items: 1. Two (2) green jumpsuits 2. Three (3) t-shirts 3. Three (3) bras 4. Pregnant incarcerated people will be issued and required to wear maternity smocks in lieu of the jumpsuits. E. Incarcerated people determined to be high security by the Population Management Unit shall be issued and required to wear yellow jumpsuits. F. Hearing- and vision-impaired incarcerated people will be issued yellow vests so that officers can readily identify them in the event of an emergency. (It is not mandatory that the vest be worn but is strongly recommended for safety reasons.) Issuance of the vest shall be documented via an ALERT ("Assistive Device"). G. All issued and exchanged clothing shall be clean and free of holes or tears, reasonably fitted, durable, easily laundered and repaired. Undergarments shall be clean, free of holes or tears, and substantially free of stains. H. Mattresses shall be free of holes and tears. A mattress with holes, tears, or that lack sufficient padding shall be replaced upon request. III. RELIGIOUS GARMENTS A. Incarcerated people are allowed to wear their religious head coverings while in custody. Incarcerated people shall not be asked to remove their religious head covering and/or be viewed without the religious head covering in front of the opposite gender, absent an exigent circumstance. [Refer to policy E-190/Religious Head Coverings(FILE: RELIGIOUS HEAD COVERINGS).] 1. The Booking area should have a supply of approved head coverings available for exchange. The incarcerated person's personal religious head covering shall be searched, inventoried, and put into the incarcerated person's property. Depending on size, the head covering may either be placed in the property envelope or stored with the incarcerated person's clothing. 2. If a jail-issued religious head covering is unavailable, the incarcerated person will be permitted to keep their personal head covering until a suitable substitute can be obtained. B. Incarcerated people who practice a religion that require a particular mode of dress other than standard-issue clothing should generally be accommodated, subject to the Jail Division's need to identify incarcerated Page 4 of 14 FRESNO COUNTY SHERIFF'S OFFICE JAIL DIVISION POLICIES AND PROCEDURES TITLE: JAIL CLOTHING NO: E-110 FILE: CLOTHING people and maintain security. A Watch Commander(or higher authority) must review the circumstances and approve or deny the religious accommodation. [Refer to policy E-420/Religious Programs and Practices (FILE: RELIGIOUS PROGRAMS AND PRACTICES.)] IV. INCARCERATED TRANSGENDER AND INTERSEX PEOPLE A. Transgender and intersex incarcerated people may request and wear underwear corresponding to their gender identity. B. Transgender and intersex incarcerated people shall be given the opportunity to shower separately from other incarcerated people. V. COURT CLOTHING A. Incarcerated people who need to be dressed into civilian clothing for a jury trial are permitted two (2) changes of court clothes. Each set of clothes may include the following: 1. One pair of pants/slacks, skirt, or dress 2. One shirt or blouse 3. One blazer/suit/sports jacket or cardigan/sweater 4. One tie 5. One belt (to be used for both sets of court clothes) 6. One pair of shoes (to be worn with both sets of court clothes) B. Incarcerated people with lengthy court cases may be allowed additional clothing with the permission of the Watch Commander. Underwear, bras, socks, pantyhose, tank tops, accessories, etc. will not be accepted. C. The clothing may be delivered to the Main Jail Lobby by the incarcerated person's private attorney, public defender, or a friend/family member. The individual delivering the court clothes must present a valid ID and have their photo taken. 1. The receiving officer shall confirm the individual's ID and initiate a new PROPERTY screen. The appropriate ITEM shall be selected Page 5 of 14 FRESNO COUNTY SHERIFF'S OFFICE JAIL DIVISION POLICIES AND PROCEDURES TITLE: JAIL CLOTHING NO: E-110 FILE: CLOTHING from the drop-down field (i.e., court clothing —family or court clothing — professional). The name, address and identification number of the person leaving the items shall be noted in the COMMENTS section, along with the date and the accepting officer's name and computer number. 2. The individual's photo shall be taken and attached to the screen. D. Once the individual's identification has been documented and returned, the clothes shall be thoroughly searched in the presence of the person who brought the clothing, in an area away from the public. NOTE: ALL clothing shall be searched, including clothing brought by an attorney. The Records hallway may be utilized for this purpose. 1. If illegal contraband is discovered, the individual may be detained. 2. If contraband is not discovered, the clothing will be accepted and the person may leave. A copy of the incarcerated person's Property screen shall be attached to the clothing. E. The receiving officer will be responsible to transport the clothing items to the Main Jail Clothing Room and scan the items using the RadPro SECURPASS body scanner. 1. The receiving officer shall retain possession of the clothing until the items can be scanned. In order to retain the chain of evidence, the clothing should never be left unattended. If the receiving officer cannot immediately transport the items, the clothing may be temporarily hung on the back wall of the Lobby Security Station. 2. The clothing should be scanned using the JID number of the incarcerated person for whom the clothing is intended. 3. If the scan reveals contraband, the item shall NOT be removed from where it is concealed. The sergeant overseeing Booking & Records shall be notified. 4. Photographs shall be taken, as best as possible. The clothing item shall be placed in an evidence locker. 5. A deputy will be called to initiate a crime report and take possession of the clothing item for evidence. The Sergeant shall provide the deputy with a copy of the scanned image on a flash drive. [Refer to Addendum B for instructions.] Page 6 of 14 FRESNO COUNTY SHERIFF'S OFFICE JAIL DIVISION POLICIES AND PROCEDURES TITLE: JAIL CLOTHING NO: E-110 FILE: CLOTHING 6. An incident report shall be written by the receiving/discovering officer and the chain of evidence documented. [1051/Body Scanner] F. Accepted clothing shall be placed into a "Court Clothes" garment bag. The bag shall be hung in the Court Clothes room, in accordance with current procedures. G. It is the incarcerated person's responsibility to have a friend or family member pick up and clean the court clothes, no more frequently than once per week. The clothes shall be thoroughly searched for contraband whenever they are returned to the Main Jail. H. Clothes that were brought in by the Public Defender need to be returned to the Public Defender's Office upon request, or upon the incarcerated person's release. All clothing that needs to be returned shall be placed into a bag and kept in the Court Clothes room. A notation shall be made on the incarcerated person's PROPERTY screen indicating that the clothes were returned. V1. PASSES, 90-DAY OBSERVATIONS, DISCIPLINE AND SAFETY CELLS A. Incarcerated people who leave the facility on a temporary basis (e.g., on a 90-day observation or extended pass)- 1. Will return their bedding, linen, and clothing issue to Clothing. When the incarcerated person returns to the facility, they will be provided with a new clothing issue. 2. Personal property shall be inventoried and stored in the Main Jail Bulk Property Storage room. [Refer to policy C-420/Inmate Property—Acceptance and Storage (FILE: PROPERTY— ACCEPTANCE &STORAGE)for storage procedures.] B. Incarcerated people placed on disciplinary status- 1. Retain their full bedding, linen, and clothing issue. 2. Personal property shall be inventoried and stored in the nearest area designated for discipline storage. [Refer to policy E-230/Inmate Discipline(FILE: DISCIPLINE)for a list of items allowed to be retained).] C. Incarcerated people who are transferred to a safety cell or observation cell: Page 7 of 14 FRESNO COUNTY SHERIFF'S OFFICE JAIL DIVISION POLICIES AND PROCEDURES TITLE: JAIL CLOTHING NO: E-110 FILE: CLOTHING 1. Any jail-issued bedding, linen, or clothing that is not retained by the incarcerated person while in the cell shall be sent to the Laundry. When the incarcerated person is removed from the cell, they will be provided with a full new clothing issue. 2. Personal property shall be searched, inventoried, and stored in the appropriate storage area: a. Main & North Jail — in the Court Clothes room in the storage area designated for safety cell placements. b. West Annex Jail — in the mezzanine storage area. VI I. INCARCERATED WORKER CLOTHING ISSUE AND EXCHANGE A. Male incarcerated workers will be issued work boots and three (3) blue jumpsuits, along with the regular incarcerated person issue. B. Female incarcerated workers will be issued four (4) gray jumpsuits and an extra t-shirt, bra, underwear, and pair of socks, along with the regular incarcerated person issue. C. Twice each week, the outdoor labor crews will be allowed to turn in their issued laundry bags filled with soiled clothing for washing and drying. D. Depending upon climatic conditions and work assignments, the following items may be issued to incarcerated workers: 1. Two (2) pairs of thermal undershirts 2. Two (2) pairs of thermal pants 3. One (1)jacket Vill. EXTRA ISSUE A. Additional clothing, bedding, or linen may be authorized by the Facility Sergeant. For example, if a condition exists that causes the inside temperature to drop below 63°F, an extra blanket and/or thermal underclothing may be issued to keep incarcerated people from being uncomfortably cold. B. The issuance of extra items shall be documented in Offendertrak via an ALERT (ALERT TYPE = XTRA). The name of the approving Sergeant shall be noted in the REMARK section. Page 8 of 14 FRESNO COUNTY SHERIFF'S OFFICE JAIL DIVISION POLICIES AND PROCEDURES TITLE: JAIL CLOTHING NO: E-110 FILE: CLOTHING IX. CLOTHING EXCHANGE A. Clothing items may only be exchanged by the Laundry Supervisor, or in his/her absence, a Services Officer assigned to the Laundry Room. 1. The incarcerated person needs to submit an Inmate Request Form, to include the reason for the request and the size needed. 2. The clothing requests will be forwarded to the Laundry Supervisor, who will fulfill the requests on the incarcerated person's laundry day. (The Inmate Request Forms are only viewed by the Laundry Supervisor on the incarcerated person's scheduled laundry day. Duplicate request forms are not necessary.) 3. The incarcerated person should be instructed to place the item that needs to be exchanged into their laundry bag. The Laundry Supervisor will retrieve and exchange the item if the request is legitimate. B. Incarcerated people shall be responsible for the safekeeping and proper use of their entire clothing, bedding, and linen issue while they are in custody. Intentionally damaged items will only be reissued with a rule violation. Items that have been lost, confiscated, or stolen must be verified/ confirmed by a floor officer. C. If an officer feels it is imperative to exchange an item prior to the incarcerated person's laundry day, and neither the Laundry Supervisor nor a Services Officer are available (e.g., on a weekend or holiday), the officer shall contact the Facility Sergeant. If the Sergeant authorizes the exchange, the item may be taken to the Clothing Room and exchanged for the new article. An incident report shall be written and the Sergeant's name who authorized the exchange shall be noted. D. Examples of legitimate clothing exchanges include, but are not limited to clothing- 1. Damaged due to normal wear and tear. 2. Excessively dirty due to a special assignment detail. 3. Contaminated (by body fluids or vermin). [Refer to policy F-130/Ectoparasite Control (FILE: ECTOPARASITE CONTROL).] 4. Issued in a size too small or too large. In the event of unprecedented or unforeseen circumstances, the on-duty Watch Commander can use their discretion to authorize large-scale clothing/bedding/linen exchanges or additional laundering. X. LAUNDRY PROCEDURES A. Incarcerated people are not permitted to wash or dry clothing in the housing areas. They are required to utilize the established laundering schedule. B. Once each week, incarcerated people will be allowed to turn in their issued laundry bag filled with soiled clothing for washing and drying. The bag will be washed, dried, and returned within twenty-four (24) hours. C. All items may be washed in the clothing bag except for the blankets and shoes (and jacket, if applicable). If blankets or shoes are in the laundry bag, the bag will not be washed. Commissary purchases (e.g., gym shorts, underwear, washcloths) may be included in the bag to be laundered. D. The blankets are laundered prior to issue. Incarcerated people may request to have their blankets exchanged once every ninety (90) days thereafter. E. Incarcerated people are responsible to ensure the laundry tag is on the outside of their bag and a knot is tied in the neck of the bag before the bag is turned in for washing. F. Each clothing bag will be tied securely with a zip-tie to protect it from coming open during the wash and dry cycles. A designated officer will supervise the assigned incarcerated person workers while they place a zip-tie just below the knot tied by the incarcerated person. XI. CONTROL OF VERMIN IN PERSONAL CLOTHING A. All incarcerated people shall be screened for signs/symptoms of ectoparasitic infestation (i.e., lice and mites) at the time of intake. Anyone who shows signs of infestation at that time will be referred immediately for treatment prescribed for each diagnosis. Infested clothing shall be cleaned, disinfected, or stored in a closed container so as to eradicate or stop the spread of the vermin. Body lice and their eggs (nits) are usually found in the seams of clothing. Lice and their eggs may be killed by: 1. Washing in water at 1300 Fahrenheit for 20 minutes 2. Tumbling in a clothes dryer at 1300 Fahrenheit for 20 minutes 3. Storing in a sealed plastic bag for 30 days 4. Treating with an insecticide specifically labeled for the purpose XII. CONTAMINATED CLOTHING A. All persons handling contaminated clothing, blankets, sheets, or towels shall wear disposable gloves. Anyone handling contaminated articles of a scabies case should also wear a disposable gown. B. The incarcerated person's laundry bag containing all contaminated articles that can be washed (i.e., blankets, sheets, towels, jail-issued clothing and commissary purchases (e.g., gym shorts, underwear, washcloths)) shall be placed into a water-soluble bag, which shall then be placed inside a red plastic bag by the incarcerated person at the time of treatment and clothing exchange. 1. The red bag may be delivered directly to the Laundry Room or placed into a "contamination bin." 2. Notify the Inmate Supplies Coordinator (or in his/her absence, the Laundry Supervisor) via email. Indicate the location of the bag and type of contamination. B. Contaminated articles will be washed separately from other laundry. Contaminated laundry should be washed in hot water(at least 130°F) and dried on the hot cycle. XIII. LOST CLOTHING A. If an incarcerated person's personal clothing cannot be located, a thorough search shall be conducted. [Refer to Addendum C.] If after all attempts to locate the clothing have failed, the following shall be performed- 1. The sergeant overseeing Booking & Records shall be notified. The incarcerated person shall be given a Lost Property Claim (J-119) form. 3. An incident report shall be written. [1019/Lost Property Claim] 4. The incarcerated person shall be provided with adequate clothing (or minimally, a white paper jumpsuit and shoes). If the incarcerated person is released during inclement weather, they shall be given a sweater or jacket from the unclaimed clothing supply. B. The completed Lost Property Claim form shall be accepted by the on- duty sergeant, signed, and forwarded with a copy of the incident report to the Records Unit Lieutenant who will then review and assign the investigation to a sergeant. 1. If the property is located, the sergeant will contact the claimant to pick up the property. A note on the claim form will be made indicating that the property was located, as well as the date and time the property was picked up by the claimant. A copy of the claim form and signed property release form will be scanned into the person's file. 2. If the property is not located, the sergeant will write a memo to the Records Unit Lieutenant that gives a brief summary of the investigation and a recommendation. The lieutenant will in turn submit a memo to the Operations Bureau Commander with a recommendation. The Operations Bureau Commander will forward the claim form and all related documents to Risk Management. XIV. ADEQUATE CLOTHING UPON RELEASE Regardless of the clothing an incarcerated person was wearing when brought into custody, all incarcerated people shall be released with sufficient clothing to protect against inclement weather. If the incarcerated person's personal attire is not suitable, they shall be given an item of outerwear (e.g., a sweater or jacket) from the unclaimed clothing supply. Page 12 of 14 FRESNO COUNTY SHERIFF'S OFFICE JAIL DIVISION POLICIES AND PROCEDURES TITLE: JAIL CLOTHING NO: E-110 FILE: CLOTHING XV. MAINTENANCE OF CLOTHING BAGS A. It shall be the responsibility of each shift assigned to Clothing to coordinate their efforts in auditing and purging the clothing bags as scheduled: Platoon Responsible to Audit(Rack Xs) During the Last Week of Platoon Al 1 through 1000 January, May, September Platoon A2 1001 through 2000 February, June, October Platoon 131 2001 through 3000 March, July, November Platoon B2 3001 and above April, August, December Court Clothing Room B. The designated officers shall ensure the following- 1. The correct Person Summary sheet (i.e., "face sheet") has been placed on the outside of the hanging clothing bag, as well as on the inside of the vacuum-sealed bag. The incarcerated person's name, photo and JID number should all be visible. 2. The clothing bag has been hung correctly, based upon the assigned rack number. 3. The incarcerated person is still in custody. C. If clothing is discovered that belongs to an incarcerated person who is no longer in custody, the discovering officer shall- 1. Notify the Sergeant responsible for Booking & Records and complete an incident report. [F015/Property Not Returned at Release] 2. Place the clothing in a brown paper bag and label the bag with the incarcerated person's name. Attach a copy of the report and store the bag in the Bulk Property Storage Room on the "Unclaimed Property" rack. 3. Email and notify the Operations Support Sergeant. The Sergeant will be responsible to notify the incarcerated person to facilitate the property return. [Refer also to policy C-460/Inmate Property and Money - Lost and Unclaimed (FILE: PROPERTY—LOST& UNCLAIMED).] Page 13 of 14 FRESNO COUNTY SHERIFF'S OFFICE JAIL DIVISION POLICIES AND PROCEDURES TITLE: JAIL CLOTHING NO: E-110 FILE: CLOTHING XVI. UNCLAIMED CLOTHING A. Clothing previously identified as reported lost and subsequently found will be stored on the "Unclaimed Property" rack in the Bulk Property Storage Room. B. A "Found Property" letter will be sent to the owner's last known address by the Operations Support Sergeant. [Refer to Addendum D.] The last known address and telephone information will be found on either the Lost Property Claim form, the arrest tag, or via Offendertrak records. C. Clothing will be retained for a period of one (1) year after an incarcerated person's release, or five (5) years after his/her death, or 120 days after a notice has been sent to his/her last known address or, in the event of his/her death, one (1) year after a notice has been sent to his/her last known next-of-kin. D. After 120 days, unclaimed clothing may be discarded or laundered and donated to a non-profit organization whose emphasis is on victims of crime. Donation of items shall be equitably distributed amongst the identified organizations. A supply of clothing shall be retained in the Clothing Room for distribution, to ensure that all incarcerated people are released with sufficient clothing. E. Any monies discovered in clothing shall be forwarded to the Business Office. Any item of value shall be forwarded to the Fresno County Purchasing Manager. A report shall be written documenting the property found, as well as the disposition of the property. Copies of the report shall be forwarded, along with the property, to the affected departments (i.e., Purchasing Manager, Business Office, etc.). Page 14 of 14
