PURPOSE: The purpose of this policy is to establish reasonable time parameters and procedures for the release of inmates in order to efficiently and legally process inmates out of custody. POLICY: It is the policy of the Fresno County Sheriffs Office Jail Division that all documents received at Jail Records will be promptly time stamped. Documents which cause the release of an inmate from custody will be prioritized and processed expeditiously. A records check shall be completed for any warrants, holds, and pending legal proceedings prior to release. It is the policy of the Fresno County Sheriffs Office Jail Division to release all persons arrested on misdemeanor offenses on a notice to appear, with certain exceptions (PC 853.6). All inmates subject to release shall be issued a citation and released from custody in accordance with policy. [Refer also to policy C-220/Citations(FILE: CITATIONS).] When the arresting agency does not desire prosecution of an inmate arrested for PC 647(f) (public intoxication), the inmate will be released without a citation pursuant to PC 849(b)(2), and in accordance with policy. [Refer also to policy C-120/Sobering Units—Intake and Release of Inebriated Inmates(FILE: PC647F).] If there has been a judicial determination that there was insufficient probable cause for arrest (i.e., "No Probable Cause Found"), or if notification of probable cause review is not received by the Jail within 48 hours from the time of arrest (i.e., "Past Time for Probable Cause"), the charge(s) shall be dispositioned, and if eligible, the inmate shall be released in accordance with policy. [Refer also to policy C-330/Probable Cause Review(FILE: PROBABLE CAUSE).] Page 1 of 14 FRESNO COUNTY SHERIFF'S OFFICE JAIL DIVISION POLICIES AND PROCEDURES TITLE: INMATE RELEASE FROM CUSTODY NO: C-210 FILE: RELEASES It is the policy of the Fresno County Sheriffs Office Jail Division that if no accusatory pleading has been filed within two (2) full court days, the inmate will be released from custody (i.e., "Past Time to File"). A bookout nag (BOKO) will be initiated on all inmates who are past time to file by 8.00 p.m. each day Fresno Superior Court is in session. It is the policy of the Fresno County Sheriff's Office Jail Division to accept and process official documents (e.g., Certificate of Release, Release Order) from arresting/holding agencies that release or cancel an inmate's charge/hold. The charge will be dispositioned as indicated (e.g., "Wrong Defendant," "No Charges Filed," "Hold Dropped," etc.). It is the policy of the Fresno County Sheriffs Office Jail Division to accept bonds for all bailable offenses in accordance with policy. Records staff shall check issued bail bonds to ensure that they are properly prepared, and promptly release the inmate. [Refer also to policy E-135/Bail, Bail Agents and Bond Surrenders(FILE: BAIL AGENTS&BONDS).] It is the policy of the Fresno County Sheriff's Office Jail Division to release inmates (or refuse to accept new arrestees) whenever the Fresno County Jail System, or any facility therein, or any housing unit therein, reaches one hundred percent (100%) of capacity. The Sheriff or his/her designee is authorized to release (or refuse to accept) inmates whenever the Fresno County Jail System, or any facility therein, or any specific housing unit therein reaches ninety percent (90%) of capacity. [Refer also to policy C-211/Criteria for Inmate Release from Custody Pursuant to Federal Court Order (FILE: FEDERAL COURT RELEASE).] It is the policy of the Fresno County Sheriff's Office Jail Division to prioritize paperwork received from the court that causes the release of an inmate (e.g., "Released Own Recognizance," "Sentenced and Released," "Case Dismissed," "Superior Court Release"). The inmate will be transferred back to the jail and processed expeditiously for release from custody, upon receipt of the paperwork (after the records check has been completed, and absent any pending legal proceedings). It is the policy of the Fresno County Sheriffs Office Jail Division to release all "Time Served" inmates at a specific time of day on their last day of sentence. Sentenced inmates may legally be released at any time of the day on the last day of their sentence, but will generally be released between 0800 and 1000 hours. It is the policy of the Fresno County Sheriffs Office Jail Division that all inmates will have a thorough computer check completed prior to their release. If the computers are inoperative for any reason, the release records may be held until the check can be accomplished. Delays that exceed more than four (4) hours shall be reviewed and approved by the Watch Commander. Page 2 of 14 FRESNO COUNTY SHERIFF'S OFFICE JAIL DIVISION POLICIES AND PROCEDURES TITLE: INMATE RELEASE FROM CUSTODY NO: C-210 FILE: RELEASES PROCEDURES: I. FACILITATING SAFE AND SUCCESSFUL RELEASES A. Inmates can obtain information to help prepare for release by submitting a request to the Offender Programs Unit. The Offender Programs Unit offers Living Skills Development Workshops and can provide information regarding health, nutrition and community resources that can assist inmates and their families after release from Jail. B. The Sheriff's Office strives to ensure that inmates are released with expediency from the Jail, but also under conditions that protects their health and maximizes the likelihood of their success in preventing rearrest. 1. Existing law authorizes the Sheriff to discharge a person from jail at any time on the last day that the person is confined that is considered to be in the best interests of that person. To best facilitate access and ensure availability of public transportation, treatment centers and family reunification services, inmates sentenced to County time are released on their scheduled release date during daylight/business hours, generally between 8.00 am and 10.00 am. 2. Any paperwork received by Jail Records that causes the release of an inmate is prioritized and processed expeditiously. The release process generally takes approximately 2 hours from the time the paperwork is received. 3. If an inmate's release is going to occur at night (between the hours of 5.00 pm or sundown (whichever is later) and 8.00 am), they may have the option to voluntarily remain in Jail (in custody) for up to sixteen (16) additional hours or until normal business hours, whichever is shorter, in order to have the ability to be discharged during daytime hours. (Refer to Section X/Voluntary Delayed Release Program.) 4. Inmates have access to make unlimited free telephone calls from the Pre-Release vestibules. C. All inmates are provided a Medical Discharge Summary. Inmates who were receiving jail-issued medications at the time of their release may Page 3 of 14 FRESNO COUNTY SHERIFF'S OFFICE JAIL DIVISION POLICIES AND PROCEDURES TITLE: INMATE RELEASE FROM CUSTODY NO: C-210 FILE: RELEASES either be provided a supply of essential medications (including all psychiatric medications), or given instructions on how to obtain the medications at a nearby pharmacy. The Medical Discharge Summary provides details concerning the pharmacy, and additional community care services available. D. Upon release, individuals who choose to wait in the Lobby may avail themselves of the conveniences of an ATM machine, a public telephone, public restrooms, and a cell phone charging station. A map of the downtown area that provides direction to the various transportation options is available for those unfamiliar with the area. (See Addendum A.) II. COURT AND OTHER RELEASING PAPERWORK A. Court paperwork is transported to the Jail Records "Bail Window" by a court deputy or other designated court or Jail personnel. Other releasing paperwork (e.g., bail bond, Certificate of Release from the arresting agency, Release Order from a parole agent, etc.) will be accepted by the Money/Property Officer or other Records Officer. B. The Money/Property Officer shall accept the paperwork and ensure that each item is immediately time stamped. C. The Money/Property Officer shall immediately forward the time stamped paperwork to the Records I Officer. D. The Records I Officer will rubber stamp the paperwork, indicate their name and computer number, and prioritize the paperwork. Paperwork which causes the release of an inmate shall be assigned to a designated Records Officer for expedited processing. III. RECORDS OFFICER RESPONSIBILITY The assigned Records Officer will: A. Check the paperwork for completeness and accuracy. B. Disposition the affected charge. C. Scan the paperwork into the inmate's records. Stamp the paperwork with the "SCANNED" stamp and indicate their name and computer number. Page 4 of 14 FRESNO COUNTY SHERIFF'S OFFICE JAIL DIVISION POLICIES AND PROCEDURES TITLE: INMATE RELEASE FROM CUSTODY NO: C-210 FILE: RELEASES D. Review any remaining charges and corresponding paperwork to ensure that all charges have been dispositioned properly. E. Check for HOLDS. F. Check for any ALERTs that require completion prior to release. 1. SMI - Inmates who are identified to have "serious mental illness" will have an SMI ALERT. Sentenced SMI inmates must be interviewed by health care staff prior to release for discharge planning and referral to community-based providers, and/or appropriate services per the individual's need. The same services will be provided to unsentenced SMI inmates provided adequate time is available prior to a legally mandated release. a. The Records Officer will be responsible to initiate an "SMI DISCHARGE" event. The Records Officer will call Mental Health and provide the name and JID number of the inmate. If Mental Health is not available, the on-duty Charge Nurse shall be contacted and notified of the pending SMI release. The Records Officer will inform whether the inmate is sentenced or unsentenced. b. After the LMFT or RN notifies Records that the interview has been completed, the Records Officer will edit the "SMI DISCHARGE" event to include the name of the health services staff who interviewed the inmate, and complete the event. c. If there is a concern about releasing the inmate, the LMFT/RN will be instructed to consult the Watch Commander for a release plan. An inmate with serious mental illness may be transported, as necessary, to a mental health facility upon release. d. If the LMFT or RN advises that discharge planning will not be performed on an unsentenced SMI inmate, that information shall be documented in the Notes section of the event. 2. H-SUICIDE or M-SUICIDE - Sentenced inmates who have been identified as a moderate or high level of suicide risk shall receive an evaluation by a mental health clinician prior to their release to the community (or treatment program) for appropriate referrals or initiation of an involuntary psychiatric hold pursuant to Welfare and Institutions Code Section 5150. The same services will be provided Page 5 of 14 FRESNO COUNTY SHERIFF'S OFFICE JAIL DIVISION POLICIES AND PROCEDURES TITLE: INMATE RELEASE FROM CUSTODY NO: C-210 FILE: RELEASES to unsentenced inmates provided adequate time is available prior to a legally mandated release. The Records Officer shall initiate a "SUICIDE RISK DISCHARGE event for any inmate with an ALERT for M-SUICIDE or H-SUICIDE. a. The Records Officer will call Mental Health and provide the name of the inmate, the JID number, and inform whether the inmate is sentenced or unsentenced. b. Upon completion of the assessment, the LMFT will notify Records that the interview has been completed. c. If the inmate is approved for release, the Records Officer will edit the "SUICIDE RISK DISCHARGE" event to include the name of the mental health clinician who interviewed the inmate, complete the event, and continue the release process. d. If there is a concern about releasing the inmate, the LMFT will be instructed to consult the Watch Commander for a release plan. e. If Mental Health advises that an evaluation will not be performed on an unsentenced inmate, that information shall be documented in the Notes section of the event. 3. MUG AND PRINT PRIOR TO RELEASE or DNA COLLECTION — both will require notification of the 1st Floor Officer and/or the Jail's Identification Bureau (i.e., the "Mug Room"). The 1st Floor Officer will ensure the inmate is routed to the Mug Room for processing prior to continuing the release process. 4. SB54 — the inmate has a qualifying condition that makes him/her eligible for transfer to immigration authorities. Once all charges have been dispositioned, ICE needs to be notified that the inmate is available for transfer. The inmate will be processed in the same manner as any other "Enroute" transfer (RELEASE TYPE = ICE TRANSFER). (Refer also to policy C-185/Immigration Status[FILE: ICE ACCESS].) G. Print the inmate's "face sheet" [Person Summary; Booking--+Booking Management--+Release; Alerts]. Rubber stamp the face sheet with the release stamp. Write the release reason, the officer's name, and indicate if the inmate has any ALERTS that require action prior to release. Page 6 of 14 FRESNO COUNTY SHERIFF'S OFFICE JAIL DIVISION POLICIES AND PROCEDURES TITLE: INMATE RELEASE FROM CUSTODY NO: C-210 FILE: RELEASES H. Perform a warrant check on the individual. Initial the stamped "Warrant Check" line indicating that the warrant check was negative. I. Initiate a BOKO event to nag the housing floor. The event is automatically generated by modifying the Release tab in Offendertrak. [Booking--+Booking Management--+Release. Ensure the Schedule Release Date corresponds with the current date. Release Type = (as applicable); Release By = (Records Officer's name).] Initial the stamped "Release Initiated By" line. NOTE: Sentenced inmates who are released pursuant to the Federal Court Order will require that the Schedule Release Date be changed to reflect the current date. J. Give the "approved" face sheet and accompanying/scanned paperwork to the Records I Officer for final approval. IV. RECORDS I OFFICER RESPONSIBILITY The Records I Officer shall be responsible for the complete and thorough final check of all release paperwork. The Records I Officer shall: A. Enter their name and computer number in the "Checklist Performed By" section of the inmate's Release screen to indicate their approval. B. Write their name on the stamped "Release Verified by" line on the face sheet as final approval, and forward the face sheet to the Money/Property Officer. C. Place the scanned court release paperwork in the blue bin next to the Records Officer I's desk. The bin will be picked up and reviewed by the Transportation Unit (for prison and psychiatric hospital commitments), then placed into the shredding receptacle. V. MONEY/PROPERTY OFFICER The Money/Property Officer shall prepare the inmate's property and money (i.e., debit card) for release and forward both, along with the face sheet, to the Lobby Officer. Page 7 of 14 FRESNO COUNTY SHERIFF'S OFFICE JAIL DIVISION POLICIES AND PROCEDURES TITLE: INMATE RELEASE FROM CUSTODY NO: C-210 FILE: RELEASES VI. HOUSING OFFICERS' RESPONSIBILITY A. When an inmate's BOKO event "nags" the housing floor, the housing Security Officer will notify the inmate to gather their jail-issue and belongings and ready themselves for release. B. When the inmate is ready to be moved out of the housing unit, the Floor Officer shall be responsible to ensure the following- 1. Retrieve the inmate's release reason from Offendertrak. [Booking—Booking Management—>Release—>Release Type] 2. Clearly mark the type of release on the inmate's "booking sheet" (e.g., TSER (time served); BOND; PTTF (past time to file); RENR (released enroute), etc.). If necessary, print a new booking sheet. [Reports—>Reports—>Inmate Reports—>Booking Data w/Photo] 3. Verify the inmate's identity. a. The inmate's identification wristband shall be checked. b. Information from the inmate's booking sheet shall be utilized to assist in confirming the inmate's identity. 4. Account for the inmate's entire clothing and bedding issue. The officer shall review the inmate's ALERTs to ensure the inmate was not issued extra items (XTRA). If so, the extra items need to be retrieved. C. When the inmate is ready to leave the floor, a housing officer shall create a housing reassignment to Main Jail 1st Floor Pre-Release (MJ01 PR). [Refer to Addendum B for procedures.] After the move has been made, one of the housing officers shall notify Central Control that the inmate is ready for transport, and the inmate shall be routed to the Main Jail/1st floor. D. If the release/enroute inmate is housed in the North or South Annex Jail, the same procedures apply with the addition of routing the inmate to the Main Jail Basement. Page 8 of 14 FRESNO COUNTY SHERIFF'S OFFICE JAIL DIVISION POLICIES AND PROCEDURES TITLE: INMATE RELEASE FROM CUSTODY NO: C-210 FILE: RELEASES VI I. CENTRAL CONTROL RESPONSIBILITY A. Once Central Control is notified by a housing officer or the Main Jail Basement Security Officer of a pending release, the Central Control Officer shall route the inmate to the Main Jail 1 st floor. B. Unless circumstances require temporary modification, general population male inmates are to be transported on Elevator #3; female, protective custody, and administrative segregation inmates are to be transported on Elevator#2. Vill. FIRST FLOOR SECURITY OFFICER'S RESPONSIBILITY A. Upon the arrival of the inmate to the Main Jail 1st Floor elevator vestibule, the 1st Floor Security Officer shall complete the following: 1. Compare the inmate's printed booking sheet to Offendertrak. Ensure that the booking sheet has been properly marked with the type of release indicated. 2. Ensure that the proper inmate is being released by checking the identification wristband. 3. All inmates leaving the facility shall have their identities verified using the Web ID fingerprint scanner. The name and photo in the Web ID system shall be compared to the inmate's information in Offendertrak and to the inmate's wristband. After completing the process, the 1st Floor Officer will write their last name, computer number, and "Web ID" on the booking sheet. 4. If an ALERT indicates it necessary, route the inmate to the Mug Room for fingerprint or DNA collection. B. Ensure that protective custody and administrative segregation inmates and/or any inmate that in the opinion of the officer (or in the interest of facility security) needs to be kept separate from other inmates, are kept separate. 1. Male inmates shall be routed to the Unit B dress-out cell to be processed into their personal clothing. 2. Females inmates shall be routed to the Unit A dress-out cell to be processed into their personal clothing. Enroute inmates are to be routed in accordance with Section XI/ENROUTERS. C. Once the inmate is dressed into their personal clothing, they shall be transferred into the designated Pre-Release units to await their release. D. Once the Main Jail Lobby Officer has received the inmate's money and property, they will contact the 1 st Floor Officer to transport the inmate to the release vestibule. E. The 1st Floor Officer shall ensure the proper identification of the requested inmate and route them to the release vestibule. IX. LOBBY RELEASE PROCEDURES A. Once the inmate reaches the release vestibule, an officer (dependant upon circumstances, either the 1st Floor Officer or Lobby Officer) shall ensure the following is completed: 1. The inmate is properly identified by utilizing the following: a. The identification wristband. b. A signature comparison from the inmate property envelope. c. Identifying inmate information contained in the inmate's records. d. The Web ID fingerprint system. 2. The inmate's property and money (i.e., debit card and accompanying instructions) are returned to the inmate. a. The property envelope, property tags (for bulk property, if applicable), and money receipt are signed by the inmate. b. The appropriate computer screens are completed. 3. All inmates are provided a Medical Discharge Summary. Inmates who were receiving jail-issued medications at the time of their release may either be provided a supply of essential medications (including all psychiatric medications), or given instructions on how to obtain the medications at a nearby pharmacy. The Medical Discharge Summary provides details concerning the pharmacy, and additional community care services available. Page 10 of 14 FRESNO COUNTY SHERIFF'S OFFICE JAIL DIVISION POLICIES AND PROCEDURES TITLE: INMATE RELEASE FROM CUSTODY NO: C-210 FILE: RELEASES 4. The identification wristband is removed. 5. The wristband, empty property envelope, (property tags, if applicable), and booking sheet are forwarded to the Phones Officer to be scanned into the inmate's records in Laserfiche. C. After the release process has been completed, the inmate's STATUS shall be immediately completed by the Lobby Officer. The transaction will change the inmate's STATUS on the PERSON SUMMARY screen to RELEASED. [Booking—Booking Management—>Release—>Release Inmate—>Yes—> Remove From Count Reason = RELEASE—OK] D. Although the Clothing Officers are responsible to ensure that an inmate is released with adequate clothing, it is ultimately the responsibility of the Lobby Officer to ensure an inmate is not released from custody without sufficient clothing to protect against inclement weather. The Lobby Officer shall contact the Clothing Room if an inmate requires additional clothing. E. The officer who opens the release vestibule door in the Main Jail lobby shall ensure that the paperwork releasing the inmate from custody has been reviewed and approved by the Records I Officer prior to opening the door to release the inmate from custody. The approving Records I Officer's name and computer number should appear in the "Checklist Performed By" field on the RELEASE tab, as well as on the stamped "Release Verified by" line on the printed face sheet. F. The inmate shall then be released from custody via the release/lobby vestibule into the Main Jail front lobby area. G. In the event an inmate is being released to another agency or a community program, the Lobby Officer shall ensure that the inmate is released into the custody of the representative from the agency/ program. H. If a law enforcement agency wishes to re-arrest an individual who is being released from custody, they may do so after the individual has completed the release process. Given that the release vestibule opens into the publicly accessible lobby, in order to alleviate any unnecessary risks to the individual, officers, and/or any bystanders, the arresting officer may request permission to enter the release vestibule to effect the arrest. a. The arresting agency must submit the request in writing, delineating a compelling need for heightened safety and security measures. b. The supervising sergeant will assess the merits of the request on a case-by-case basis. Approved requests shall be documented in an incident report (1059/Release Vestibule Arrest). c. The individual's property (particularly any property containing weapons or items that could be used as weapons) should be placed into a manila envelope and provided upon exit from the release vestibule. d. Under no circumstances shall the inmate's release be delayed or postponed. 2. If an inmate exhibits aggressive or hostile behavior during the release process, the releasing officer may seek approval from the supervising sergeant to admit the arresting agency into the release vestibule for safety and security reasons. Such action shall be documented in an incident report (1059). X. VOLUNTARY DELAYED RELEASE PROGRAM The Fresno County Sheriff's Office offers a voluntary delayed release program to inmates who have been ordered released by the court (to be effected the same day). The program allows inmates to stay in custody for up to sixteen (16) additional hours or until normal business hours, whichever is shorter, in order to offer the inmate the ability to be discharged to a treatment center or during daytime hours. A. If an inmate wishes to participate in the voluntary delayed release program, the inmate: 1. Must provide expressed written consent that they are voluntarily remaining in jail custody pending transfer or travel arrangements. A Voluntary Delayed Release form (Addendum C) must be completed and signed by the inmate. May revoke their consent and be discharged as soon as possible and practicable. The "Revocation" portion of the Voluntary Delayed Release form must be completed and signed by the inmate. 3. Must meet one of the following requirements: a. Be released on their own recognizance b. Have charges dismissed by the court c. Be acquitted by a jury d. Be cited and released on a misdemeanor charge e. Posted bail f. Had charges dropped by the prosecutor B. If the inmate has posted bail and elects to delay their release, he or she shall notify the bail agent as soon as possible and practicable regarding his/her decision. C. The inmate will be placed into a designated holding cell and permitted to retain access to a telephone in order to make telephone calls to either arrange for transportation, or to notify the bail agent, or both. D. Staff members shall not discourage or encourage inmate participation in the voluntary delayed release program. XI. ENROUTERS A. When Records receives notification that an inmate is to be transported enroute to another facility, the Records I Officer shall ensure that Health Services is immediately notified of the impending transfer by faxing the enrouter list to Health Services. B. Health Services shall provide a medical summary for each inmate transferred from the facility. C. It is the Records I Officer's responsibility to ensure that the medical summary packet is received from Medical staff. Page 13 of 14 FRESNO COUNTY SHERIFF'S OFFICE JAIL DIVISION POLICIES AND PROCEDURES TITLE: INMATE RELEASE FROM CUSTODY NO: C-210 FILE: RELEASES D. If the inmate is being released to the US Marshal's Service, the transporting officers shall be directed to the Booking Nurse. The Booking Nurse will provide the US Marshal with a supply of medications. E. BOKO's on inmates going enroute shall be initiated at least two (2) hours prior to the time the inmate is scheduled to be picked up. When an inmate is going enroute, that inmate shall be in the enroute cell and ready for release to the transporting agency within two (2) hours after the BOKO is initiated. F. When the inmate arrives on the Main Jail 1st floor, the 1st Floor Security Officer shall- 1. Route male enroute inmates to the Enroute units and notify the Clothing Officers. The male inmates shall wait in the Enroute units for transportation. 2. Route female inmates to the Unit A dress-out area and notify the Clothing Officers. Once the female inmates are dressed into their personal clothing, they shall be routed to a designated female holding unit to wait for transportation. G. The Money/Property Officer shall- 1. Ensure that the enroute inmates' property and money (i.e., debit card) are properly released and signed over to the transportation officers. If an inmate is transported enroute to a prison or other facility that does not accept debit cards, the Business Office can issue a check. The check will take approximately 2-3 weeks to process and will be mailed directly to the receiving facility. 2. Deliver the medical summaries to the transporting officers. H. All enroute inmates shall be released via the enroute release vestibule in the booking area with the releasing agency present. The Central Control Officers shall ensure the enroute door to the sallyport is properly opened, closed, and maintained in a secure manner. I.
