ORGANIZATION A-105 2017 FRESNO COUNTY SHERIFF'S OFFICE JAIL DIVISION POLICIES AND PROCEDURES TITLE: JAIL DIVISION ORGANIZATION NO: A-105 TITLE: ORGANIZATION EFFECTIVE DATE: 11-04-91 REVISED: 01-03-96, 01-01-99, 04-01-00, 02-01-02, 08-01-02, 03-01-03, 06-01-06, 12-16-13, 03-15-17 AUTHORITY: Sheriff J. Zanoni APPROVED BY: Assistant Sheriff T. Gattie REFERENCE: California Code of Regulations, Title 15, Section 1029 and Fresno County Sheriffs Office Policies and Procedures, Sections 102, 200 and 1062; and Hall, et al. v. County of Fresno, 1-11-CV-02047-LJO-BAM (2015). PURPOSE: The purpose of this policy is to establish and maintain the organizational chain of command and channels of communication for all employees assigned to the Fresno County Sheriff's Jail Division. POLICY: It is the policy of the Fresno County Sheriffs Office Jail Division that the organizational chart in this policy shall be the Jail Division's official channel of communication and the chain of command for all employees. PROCEDURE: I. THE CHAIN OF COMMAND The chain of command establishes the clear line of authority and formal channels that provide a path for dissemination of information, both upward and downward. Employees shall utilize, recognize, and respect the chain of command in all official actions as designated by the order of rank. A. All official communications, information requests, suggestions and complaints shall be confined to official channels. Each link in the chain of command shall be respected in this regard. B. It shall be the responsibility of each echelon to forward communications to the next higher echelon. The structural hierarchy of the Sheriff's Office is organized by rank;each position subordinate to the rank above it. The chain of command and order of rank shall be as follows (refer also to the Jail Division Organizational Chart, provided as Addendum A): 1. Sheriff 2. Undersheriff 3. Assistant Sheriff 4. Captain / Director 5. Lieutenant/ Manager/ Coordinator 6. Sergeant / Supervisor 7. Correctional Officer IV/ Deputy IV 8. Correctional Officer, Deputy, Community Service Officer, and professional staff. Various civilian positions may serve in intermediary supervisory capacities, depending on assignment. II. EXCEPTIONS TO THE CHAIN OF COMMAND A. Discrimination/Harassment/Retaliation. Any employee who feels that the Sheriffs Office policy on discrimination has been violated shall immediately report such to their immediate supervisor. Employees not comfortable with reporting violations to their immediate supervisor, may bypass the chain of command and report the allegation to any supervisor (up to, and including, the Sheriff). B. Internal Affairs investigations. Allegations of employee misconduct and/or impropriety may be reported directly to a Watch Commander. This does not preclude the employee's option to lodge their complaint directly with the Internal Affairs Unit. C. Staff sexual abuse, sexual assault, sexual harassment, or sexual misconduct toward inmates. Any employee who feels that the Jail Division's policy on Sexual Misconduct and Abuse (D-360) has been violated by another employee should report the violation directly to the on-duty Watch Commander. Employees not comfortable with reporting violations of the policy to the on-duty Watch Commander may bypass the chain of command and report the allegation to any supervisor. Psychological service requests are considered confidential and it is not necessary for an employee to inform their supervisor or seek a referral. E. Matters of a strictly personal nature not already involving the Sheriffs Office. III. ORGANIZATION CHART A. The Assistant Sheriff is entrusted with the direction and administration of the Jail Division. B. Lines of control permitting the delegation of authority, the placing of responsibility, the supervision of operations, and the coordination of effort are hereby established in conformity with the organization chart. C. Collateral duties and assignments have been designated so as to assign accountability and assure the effective performance of the Jail Division (refer to Addendum B). Page 3 of 3
